ph39 Terms & Conditions

ph39 is an online gaming platform serving the Philippine market. ph39 provides Filipino players with access to online casino games including live dealer table games, slot games, digital bingo, sports betting, and sabong. All services are provided in Philippine Peso (₱ / PHP) and are accessible to eligible players residing in the Philippines.

ph39 operates within the regulatory framework established by the Philippine Amusement and Gaming Corporation (PAGCOR), the government agency responsible for overseeing authorized gaming activities in the Philippines. These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines.

These Terms apply to all services provided by ph39, including but not limited to: account registration, balance management, game play, promotional offers, customer support interactions, and use of all features of the ph39 platform. By accessing any part of the ph39 platform, you acknowledge that you have read and agree to these Terms.

In these Terms, the following words and expressions have the meanings set forth below:

3.1 Eligibility Requirements

To be eligible to register and maintain an active ph39 Account, you must satisfy all of the following conditions at all times:

• You are at least 21 years of age.
• You are a natural person — corporations, organizations, and artificial entities may not register Accounts.
• You are accessing the ph39 Platform from a jurisdiction where online gaming is not prohibited.
• You are not subject to a self-exclusion order, whether requested through ph39 or through any PAGCOR-administered exclusion program.
• You are acting on your own behalf and not as an agent or nominee for any third party.
• All information you provide during registration and subsequent KYC processes is accurate, current, and complete.

3.2 Registration Process

To register an Account, you must provide a valid email address or Philippine mobile number (+63 format), create a secure password, and confirm that you meet the eligibility requirements above including the 21+ age requirement. ph39 reserves the right to require identity verification (KYC) at any time, including prior to processing a withdrawal or activating a bonus.

3.3 One Account Per Player

Each eligible individual may maintain only one ph39 Account. ph39 will close duplicate Accounts without notice, and any balance held in a duplicate Account may be forfeited at ph39's discretion. Players who discover they have inadvertently created a duplicate Account must contact support immediately to resolve the situation.

3.4 KYC Verification

ph39 is required to verify the identity of all Players. You must submit a valid Philippine government-issued identification document — including but not limited to a Philippine Statistics Authority (PSA) PhilSys ID, driver's license, SSS ID, UMID, postal ID, or Philippine passport — upon request. KYC must be completed before your first withdrawal. ph39 may suspend Account functionality pending completion of KYC at any time.

As a registered ph39 Player, you are responsible for all activity conducted through your Account. You are required to:

• Keep your login credentials, including your password and any two-factor authentication codes, strictly confidential. ph39 will never ask for your password via any communication channel.
• Notify ph39 immediately via live chat or email at [email protected] if you believe your Account has been accessed without your authorization.
• Maintain accurate and current personal information in your Account profile. Changes to your registered name, mobile number, or email address must be submitted for review and may require additional KYC documentation.
• Ensure that your Account is not accessed by any other person, including family members. You are liable for all bets placed on your Account regardless of who placed them.
• Not transfer, sell, or assign your Account or any balance therein to any other person.

5.1 Deposits

ph39 accepts deposits via GCash, Maya, QR Ph, GrabPay, InstaPay, PesoNet, BPI, BDO, Metrobank, and 7-Eleven CLiQQ. The minimum deposit amount is ₱100. All deposits are credited to your ph39 Account in Philippine Peso at the exact received amount, with no currency conversion or spread applied by ph39. Deposits via GCash and Maya are typically instant. Bank transfer deposits (PesoNet, BPI, BDO, Metrobank) may take 15–60 minutes depending on the originating institution and network conditions.

ph39 does not accept deposits from third-party accounts. All deposit sources must be in the Player's own name and must match the identity registered to the ph39 Account. Deposits received from third-party sources may be returned and the Account suspended pending investigation.

5.2 Withdrawals

The minimum withdrawal amount is ₱200. Withdrawal requests are processed to the same payment method used for the most recent deposit where possible. All withdrawal requests require a completed KYC process. ph39 targets a withdrawal processing time of same-day to 24 hours for GCash and Maya withdrawals, subject to verification requirements.

ph39 reserves the right to request additional documentation to verify the source of funds before processing withdrawal requests above certain thresholds, in accordance with Philippine Anti-Money Laundering Act (AMLA) requirements.

5.3 Dormant Account Policy

An Account is considered dormant after 12 consecutive months of inactivity (no login, deposit, or withdrawal). ph39 may impose an administrative inactivity fee on dormant Account balances, not to exceed ₱100 per month, after providing advance notice to the Account holder at their registered email or mobile number.

ph39 offers promotional bonuses to new and existing Players from time to time. All bonuses are subject to the following general terms in addition to any specific terms stated at the time of the offer:

• Wagering Requirements: All Bonus Funds are subject to wagering requirements that must be met before Bonus Funds or winnings generated from Bonus Funds may be withdrawn. The applicable wagering requirement will be clearly stated on the promotion offer.
• Eligible Games: Not all games contribute equally to wagering requirements. Live casino, slots, and sports bets may contribute at different rates. The contribution rate for each game category is stated in the individual promotion terms.
• Expiry: Bonus Funds not used and wagering requirements not met within the stated validity period will be forfeited automatically. ph39 will provide reasonable advance notice of bonus expiry via in-platform notification.
• One Bonus at a Time: Only one promotional bonus may be active on an Account at any time unless specifically stated otherwise in the promotion terms.
• Abuse Prevention: ph39 reserves the right to void Bonus Funds and any associated winnings, and to close an Account, if it determines that a bonus has been claimed or used in an abusive or fraudulent manner, including through the creation of duplicate Accounts.

All games on ph39 are governed by individual game rules accessible within the game interface. The following general provisions apply across all game categories:

• All game outcomes on ph39 are determined by certified Random Number Generators (RNG) or by live physical game equipment (in the case of live dealer tables), independently tested and certified for fairness.
• In the event of a technical malfunction during a game round, ph39 will void the affected round and return the wagered amount to the Player's Balance. ph39 is not liable for any alleged losses resulting from a technical malfunction.
• Bets placed and confirmed are final. ph39 will not accept cancellation requests for confirmed wagers except in cases of verifiable technical error.
• Maximum win limits may apply to individual game rounds or sessions. Where applicable, maximum win limits are stated within the game interface. Winnings exceeding the applicable maximum win limit may be capped and the excess forfeited.
• ph39 reserves the right to void bets placed after the official result of an event is known, regardless of whether ph39's systems accepted the bet in error.

The following conduct is strictly prohibited on ph39:

• Use of automated software, bots, scripts, or any other artificial means to interact with the ph39 Platform, place bets, claim bonuses, or manipulate game outcomes.
• Collusion with other Players or third parties to influence game outcomes, including but not limited to multi-account play, chip dumping, and coordinated betting strategies.
• Exploitation of software bugs, errors, or vulnerabilities in the ph39 Platform. Any Player who discovers a software error must report it to ph39 support immediately and must not exploit it for financial gain.
• Registration of multiple Accounts for any purpose, including circumvention of self-exclusion, repeated bonus claiming, or any other reason.
• Providing false, misleading, or fraudulent information during registration, KYC, or any interaction with ph39 support.
• Money laundering or any use of ph39 to conceal, transfer, or legitimize proceeds of illegal activity. ph39 is subject to the Philippine Anti-Money Laundering Act (AMLA) and its amendments and is legally required to report suspicious transactions.
• Accessing ph39 on behalf of or for the financial benefit of a third party, including a prohibited person (e.g., a person subject to self-exclusion).
• Using chargebacks or fraudulent payment disputes to retrieve funds that were legitimately deposited and wagered on ph39.

ph39 is committed to promoting responsible gaming among Filipino players. We believe that gambling is a form of entertainment and should be enjoyed as such. ph39 operates under the responsible gaming standards applicable within the PAGCOR regulatory framework.

The following responsible gaming tools are available to all ph39 Account holders free of charge and without requiring justification:

• Deposit Limits: Daily, weekly, or monthly deposit caps that you define.
• Session Time Limits: Automatic logout after a defined period of continuous play.
• Reality Check Notifications: On-screen reminders at defined intervals showing total time played and net result for the session.
• Cooling-Off Period: A temporary account suspension of 1 day to 6 weeks, taking effect within 24 hours of request.
• Self-Exclusion: A longer-term suspension of 6 months, 1 year, 2 years, or indefinite, taking effect immediately upon request.

All content on the ph39 Platform — including but not limited to software, text, graphics, logos, game content, audiovisual materials, trademarks, and the overall design and layout of the Platform — is the property of ph39 or its licensors and is protected by applicable intellectual property laws in the Philippines and internationally.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the ph39 Platform for personal, non-commercial gaming purposes in accordance with these Terms. You may not reproduce, distribute, modify, create derivative works from, reverse-engineer, or commercially exploit any content or element of the ph39 Platform without our prior written consent.

To the maximum extent permitted by applicable Philippine law, ph39's total liability to any Player for any claim arising out of or related to these Terms or the use of the ph39 Platform shall not exceed the total amount deposited by that Player in the 30-day period immediately preceding the event giving rise to the claim.

ph39 shall not be liable for any indirect, incidental, special, consequential, or punitive losses, including but not limited to: loss of profits, loss of data, loss of goodwill, or any other intangible losses arising from your use of or inability to use the ph39 Platform.

ph39 does not warrant that the Platform will be available uninterrupted or error-free at all times. Planned maintenance, emergency downtime, network outages, or circumstances beyond our control may result in temporary unavailability. ph39 will use commercially reasonable efforts to notify Players in advance of planned maintenance windows.

ph39 collects, processes, and stores personal data in accordance with the Philippines Data Privacy Act of 2012 (Republic Act No. 10173) and its implementing rules. Our full data practices are detailed in our Privacy Policy, which forms part of and is incorporated into these Terms by reference.

By registering an Account with ph39, you consent to the collection and use of your personal data as described in the Privacy Policy, including for KYC verification, transaction processing, fraud prevention, regulatory compliance, and customer support purposes.

ph39 will not sell your personal data to third parties for marketing purposes. Personal data may be shared with payment processors, KYC verification partners, and regulatory authorities where required by law or necessary to perform the services described in these Terms.

13.1 ph39's Rights

ph39 reserves the right to suspend, restrict, or permanently close any Account at any time, with or without prior notice, for any of the following reasons:

• Breach of these Terms or any applicable law or regulation.
• Reasonable suspicion of fraud, money laundering, identity theft, or other criminal activity.
• Provision of false or misleading information during registration or KYC.
• Detection of a duplicate Account.
• Irregular betting patterns suggesting manipulation or exploitation of the Platform.
• Request of the Account holder.
• Legal requirement or direction from PAGCOR or another competent authority.

13.2 Effect of Closure

Upon Account closure for non-violation reasons, any real-money Balance remaining in the Account will be returned to the Player's registered payment method within a reasonable period, net of any outstanding obligations. Bonus Funds are forfeited upon Account closure in all circumstances. Upon closure for violation of these Terms, ph39 reserves the right to forfeit the entire Account Balance.

13.3 Player-Initiated Closure

You may request permanent Account closure at any time by contacting ph39 support. Your request will be processed within 5 business days. Any Balance remaining at the time of closure (excluding Bonus Funds) will be returned to your registered payment method.

These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

In the event of a dispute between a Player and ph39 relating to these Terms or the Platform, the parties agree to first attempt resolution through ph39's internal complaint process by contacting support via live chat or email. ph39 targets a response to all formal complaints within 5 business days.

If a dispute cannot be resolved through ph39's internal process, it shall be referred to the appropriate Philippine courts or regulatory bodies having jurisdiction, including PAGCOR where applicable. Players who believe a matter relates to PAGCOR's regulatory oversight may direct complaints to PAGCOR through the official channels established by that agency.

ph39 reserves the right to amend these Terms at any time. Material changes will be communicated to registered Players via in-platform notification and/or email to the address registered with the Account, with at least 14 days' advance notice before the new terms take effect.

The current version of these Terms will always be available at ph39.club/terms-conditions. The "Effective Date" at the top of this document indicates the date the current version took effect. Your continued use of the ph39 Platform after the effective date of any revised Terms constitutes your acceptance of the revised Terms.

If you do not agree with any material change to these Terms, you may close your Account before the effective date of the change and any real-money Balance will be returned to you in accordance with Section 13.3.
